Parish, 2021 U.S. App. LEXIS 21464 (6th Cir. 2021), the Sixth Circuit Court of Appeals ruled that counsel was not ineffective in failing to pursue a trial competence evaluation because the client did not give counsel reason to doubt competency and it is not enough, without more, for the defendant to have previously been given the diagnosis of a mental illness and been prescribed medication.
