Rehabilitation Potential in Juvenile Sentencing

Haag, 495 P.3d 241 (Wash. 2021), the Washington Supreme Court overturned a 46-year sentence that had been imposed on Timothy Haag by a resentencing court following the U.S. Supreme Court decision in Miller v. Alabama, 567 U.S. 460 (2012). The Washington Supreme Court ruled that the resentencing court failed to properly weigh mitigation factors for Mr. Haag, who had been convicted and sentenced for acts that occurred when he was 17 years old. Six of the nine justices also said that the 46-year sentence is unconstitutional as it amounted to a de facto life sentence.
