Johnson, 501 P.3d 651 (Cal. 2022), the California Supreme Court considered whether the superior court erred in admitting statements made to a prosecution-retained psychiatrist who interviewed the defendant the night he shot and killed an officer. The court ruled that there was no Fifth Amendment error from admitting the defendant’s statements to the psychiatrist.
