Regulation and Non-Compliance : Magnitudes and Patterns for India's Factories Act

[摘要] Non-compliance with regulations byenterprises is said to be rife in developing countries. Yetthere is limited systematic evidence of the magnitude ofnon-compliance at the enterprise level. Making innovativeuse of two complementary data sources, non-compliance forIndia's Factories Act has been quantified without thequestion of illegality ever being raised directly withenterprises. It is found that more than twice as many firmsare not complying as are complying. Further, the number ofnon-compliant firms is much larger than the number of firmsadjusting out of the regulation. Thus non-compliance withthe Factories is a key feature of the "missingmiddle" in India. The main trends and patterns ofnon-compliance are explored herein and key issues forfurther analytical and policy research are highlighted.
